These Terms & Conditions ("Terms") govern your access to and use of the AutoMind website, mobile applications, and related services (the "Services"). By creating an account, booking a service, or otherwise using the Services, you agree to these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business.

1. The Services

AutoMind operates a technology platform that facilitates connections between customers seeking automotive services and independent or partnered service providers or technicians. AutoMind is not always the direct provider of mechanical work; where third parties perform services, their work may be subject to additional terms or warranties they provide.

Features, coverage areas, pricing, and availability may change. We do not guarantee uninterrupted or error-free operation of the Services.

2. Eligibility and accounts

You must meet the minimum age and legal capacity requirements in your jurisdiction to use the Services. You agree to provide accurate, current, and complete registration information and to update it as needed.

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose security or legal risk.

3. Bookings, pricing, and payment

When you request a service, you agree to the pricing, fees, and estimated scope presented in the app at the time of booking, subject to adjustment if the on-site assessment reveals additional work that you approve. Taxes and applicable charges may apply.

Payments are processed through our designated payment methods. You authorize us and our payment processors to charge your selected payment method for amounts due. Invoices, receipts, and refund rules are described at checkout and in our in-app policies.

4. Cancellations, rescheduling, and refunds

You may cancel or reschedule in accordance with the cancellation windows and rules shown in the app. Fees may apply for late cancellations or no-shows after a provider has been dispatched, as disclosed before you confirm.

Refunds, when applicable, are processed to the original payment method unless otherwise required by law. Disputes regarding service quality should first be directed to customer support.

5. User conduct

You agree not to misuse the Services, including by harassing providers or staff, submitting false information, circumventing payments, scraping or reverse engineering the app except as permitted by law, interfering with security features, or using the Services for unlawful purposes.

We may investigate violations and cooperate with law enforcement. We may remove content, restrict features, or terminate access for breaches of these Terms.

6. Provider services and limitations

Technicians and partners are responsible for performing agreed work with reasonable skill and care. Diagnostic opinions and time estimates are estimates only unless expressly guaranteed. Roadside and on-site conditions may affect outcomes.

AutoMind does not warrant third-party services beyond facilitating the connection and platform tools. Any manufacturer warranties on parts remain subject to manufacturer terms.

7. Intellectual property

The Services, including software, branding, text, graphics, and layout, are owned by AutoMind or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal or internal business use in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent, except where mandatory law allows.

8. Disclaimers

Except where prohibited by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will meet your requirements, that data will be error-free, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the maximum extent permitted.

9. Limitation of liability

To the fullest extent permitted by law, AutoMind and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of the Services.

Our aggregate liability for claims arising out of or relating to the Services or these Terms is limited to the greater of (a) the amounts you paid to AutoMind for the Services giving rise to the claim during the six (6) months before the claim, or (b) one hundred dollars (USD 100), except where liability cannot be limited by law.

10. Indemnity

You agree to defend, indemnify, and hold harmless AutoMind and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys fees) arising from your use of the Services, your violation of these Terms, your violation of third-party rights, or content you submit.

11. Governing law and disputes

These Terms are governed by the laws of the jurisdiction we designate in your regional terms, without regard to conflict-of-law principles, except where consumer protection laws of your country of residence require otherwise.

Disputes will be resolved in the courts or arbitration forum we specify for your region, unless mandatory law provides a non-waivable right to bring claims in your local courts. Please review any region-specific addendum in the app.

12. Changes to the Terms

We may modify these Terms at any time. We will post the updated Terms and revise the "Last updated" date. For material changes, we will provide notice as required by law. Your continued use after the effective date constitutes acceptance of the revised Terms where permitted.

If you do not agree, you must stop using the Services and close your account where available.

13. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.

These Terms, together with our Privacy Policy and any policies referenced in the app, constitute the entire agreement regarding the Services.
